Nobody's Child?

A pre-operative male to female transsexual is starting a 10 month jail sentence in Wisconsin, but what section should she be in - male or female? She thinks female - what do you think?

Story: Wisconsin State Journal; Hat tip: Ann Althouse

He may think he is female, but he is not, and therefore should be placed in a male prison. There really isn't any question about it. Maybe if he was post-op there would be but he is not.

But the state has changed her gender to female on some official documents. Does this put an obligation on them to now recognise her as female in all contexts or?

I'm not sure it does, I'm just wondering. Also I balk at the thought of the security risks to her if she were put into a male prison wing...

"But the state has changed her gender to female"

But she is still a he - his sex is male. There should be no question.
